‘Elon Musk is heating up with the SEC accused of breach of trust.’
Lawyers representing the CEOs of Tesla and Elon Musk added charges against the Securities and Exchange Commission (SEC) and this time accused the SEC of leaking information about a federal investigation in retaliation against Musk.
Attorney Alex Spiro once again voiced the charges in a letter sent to U.S. District Judge Alison Nathan.
In the letter, he noted that the SEC is openly seeking revenge against Elon Musk who used his recent First Amendment rights to criticize the SEC on public dockets and with a Court petition for relief.
It is not the first time such a letter has been made, where before this Intraday.my also wrote about the dispute between Elon Musk and the SEC.
However, Spiro did not disclose what investigation or what information was leaked by the SEC, in the letter he only stated that an SEC member had leaked an information regarding the investigation without presenting any supporting evidence.
Additionally, in a separate letter Spiro specifically asked SEC staff to ‘preserve their records and devices’ and has reported the matter to the SEC’s Office of the Chief Inspector.
So far SEC officials have not issued any further statements on the matter.
Meanwhile, Musk claimed the SEC failed to pay Tesla shareholders the $ 40 million collected from the 2018 settlement issue on its Twitter page.
The SEC has responded to the allegations by stating it needs time to develop a plan given the complexities of distribution and it plans to submit it to a judge by the end of March.
