'As the saying goes, never give up before fighting.'
After being snubbed several times from various directions, now it is Serba Dinamik Holdings Bhd's turn to question the motive for the Suruhanjaya Sekuriti Malaysia (SC) indictment against false facts in the court filing dated February 7, 2022.
As a context, SC last December indicted the directors and employees of Serba Dinamik on charges of presenting false facts to Bursa Malaysia under Section 369(a)(B) of the 2007 Capital Market and Service Deed (CMSA).
In addition, SC also received an arrest warrant against the Chief Executive Officer of the company and the Director of Group Affairs, Datuk Mohd Abdul Karim Abdullah.
On the other hand, Serba Dinamik argued that SC should present evidence of how the facts submitted were false as alleged.
The argument is, SC needs to provide documents showing how the RM6,014 billion notes included in the company's report can be said to be fake.
The matter brought up by Serba Dinamik was why the 4th quarter report, which ended on 31 December 2020, became the main focus, while the 4th term's decision was the result of the collection of the first term to the 3rd financial year 2020.
In addition, the oil and gas company also accused SC of threatening the company's accomplices by offering them to be witnesses against the firm and its management.
Clearly, SC had manipulated Serba Dinamik's accomplices by stating that they would not be charged if they accepted the offer made.
